Terms and Conditions of Entry

General

Information on how to enter this competition and prizes form part of the Terms and Conditions of Entry. Entry into this competition, by leaving a review as described below, is deemed acceptance of these Terms and Conditions. These Terms and Conditions supersede all other references to this competition with regard to any inconsistency between these Terms and Conditions and any other reference to this competition. The Promoter is Bright Viper Pty Ltd (ABN 21 635 915 945) (the ‘Promoter’). The Promotional Period is a single calendar month. The prize set out below is available to be won every calendar month from the first Promotional Period (December 2024) until the competition is ended at the sole discretion of the Promotor.

Who Can Enter

Subject to the clauses below, entry is open to all residents of Australia who fulfil the requirements set out below (‘Eligible Entrants’). Eligible Entrants must be over the age of 18 on the date of entry and have a valid email address. Entry is subject to all State and Territory laws and regulations. Eligible Entrants should ensure that their entry into the review competition is not prohibited by the state that they live in. The competition is governed by regulations in the state of Queensland. Employees, and their immediate families, of Bright Viper Pty Ltd are not eligible to enter this competition.

How to Enter

To enter Eligible Entrants must, during the Promotional Period, provide a review of a Fuel Doctor product or package sold by the Promotor and the review must be published on their website https://www.buyfueldoctor.com.au. The review must be regarding the service at Buy Fuel Doctor and/or Fuel Doctor (the product) only, and must not refer to or otherwise mention any competitor who sells Fuel Doctor or any other similar product and must not be offensive, defamatory, or derogatory. By submitting an entry into this competition, Entrants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter. Opting out during the period of the competition will remove their entries from the competition.
Entrants must provide contact details on request to be eligible to win. Entrants may only enter in their own name and with their own email address. Incomprehensible, illegible, or incomplete entries may be deemed invalid.

Number of Entries Permitted

Up to Four (4) entries per Eligible Entrant per Promotional period will be permitted. One (1) entry must be a review on the above-mentioned website. The three (3) additional entries can be made up of a combination of a single review on each of the following platforms:

1. eBay https://www.ebay.com.au/str/buyfueldoctor,
2. Facebook https://www.facebook.com/buyfueldoctor, or
3. Google https://g.page/buyfueldoctor/review.

Entrants found to be creating multiple accounts for entry may have all entries invalidated. Entrants may be asked to provide proof that the reviews on other platforms have been created by that Entrant. Failure to provide proof when requested will result in all entries by that Entrant being invalidated.

Open, Close, Draw, and Publish Dates

Competition opens 26th of November 2024 and will be closed at the sole discretion of the Promoter. With the exception of the first Promotional Period (which starts on the 26th of November 2024 and ends of the 31st of December 2024), the Promotional Period opens on the 1st day of each month at 00:00, and closes on the last day of that calendar month at 23:59. Any times noted in these Terms and Conditions or promotional posts are local times, based on the location of the Promoter. If any draw date falls on a public holiday, as defined in the state of the Promoter, that draw will be conducted on the next business day. Entries must be received by the Promoter prior to the Promotional Period close date and time. The monthly winner will be the first valid entry drawn on the 7th day after the end of each Promotional Period. The Promoter will ensure that all entries have an equal chance of winning a prize. The winner will be announced at the time of the draw on Facebook and other social media channels. The winner will be notified by email within two business days of the draw. The winner must respond to that email to claim their prize within twenty-eight (28) days of the draw. Prizes will be available for shipping within twenty-eight (28) days of the draw. The Promoter may conduct further draws in order to distribute any prizes unclaimed after twenty-eight (28) days of each draw, subject to State and Territory laws and regulations. Winners of any further draws will be notified by email within two business days of the draw.

The monthly prize will be valued to at least $45.00 (Including GST), as at 26th November 2024. The total number of competition winners in each monthly competition is one (1). The prize on offer will be the Promotor’s choice of one (1) of the following items:

Further Terms and Conditions

Any Entrant found to have used a third party (including online competition entry sites) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. Any Entrant found to be entering incorrect contact details, including incorrect email contact details, will have all entries invalidated and any claim to any prize will be invalidated. Any Entrant found to have won a prize in any Promotional Period in the preceding three (3) months, will have all entries invalidated and any claim they have to any prize will be invalidated. If such an Entrant is awarded a prize and then found to have breached this clause, the Entrant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any Entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the Entrant has breached this clause. An Entrant must provide any requested documentation to the Promoter upon request. The Promoter reserves the right to disqualify any Entrant who provides false information or who seeks to gain an unfair advantage or to manipulate this competition. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.

The Promoter reserves the right to request winners to sign a winner’s deed of release (and indemnification) or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address, and/or proof of entry validity in order to claim a prize.

The Promoter reserves the right to conduct a redraw in the event that an Entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.

The Promoter’s decision in relation to any aspect of the competition is subject to State and Territory laws and regulations but also final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost, misdirected, or incomplete entries. Prizes are subject to availability, not transferable or exchangeable, and cannot be taken as cash. The Promoter, their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.

Privacy Collection Statement

By submitting an entry into this competition, Entrants consent to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter. Opting out during the period of the competition will remove their entries from the competition.

The Promoter and its related entities collect Entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The Promoter may disclose personal information collected to an agent who is engaged to conduct the competition draw and for prize fulfilment. The Promoter may also disclose personal information collected to Australian regulatory authorities where required. The Promoter will otherwise handle your personal information in accordance with its Privacy Policy available at https://buyfueldoctor.com.au/privacy-policy/.

Copyright, Statutory Guarantees, Waiver, and Liability

All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. In participating in the prize draw, the winners agree to participate and co-operate as required in all editorial activities relating to the competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.

The Promoter (subject to State and Territory laws and regulations) reserves the right to amend, cancel, or suspend this competition if an event beyond the control of the Promoter corrupts or affects the administration, security, fairness, integrity, or proper conduct of this competition or if such a change is required to ensure the safety of the Promoter, its representatives and of Entrants. Such changes may include the timing of any draw, the conduct of any prize-related activities, and the value or amount of any prizes. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, computer-generated entries and the use of “scripting” is not permitted and will not be accepted. Any cost associated with accessing the promotional website is the Entrant’s responsibility and is dependent on the Internet service provider used.

Nothing in these Terms and Conditions limit, exclude, or modify or purports to limit, exclude, or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special, or consequential, arising in any way out of:

1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
2. any theft, unauthorised access ,or third party interference;
3. any entry or prize claim that is late, lost, altered, damaged, misdirected, or incomplete (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
4. any variation in prize value to that stated in these Terms and Conditions;
5. any tax liability incurred by a winner or Entrant; or
6. use of a prize.
