Supply and Delivery

Subject to you complying with the terms and conditions listed on this website and acceptance of your order by us, we will sell and supply the products to you as shown on your order confirmation. For reasons outside our control (including but not limited to: manufacturer shortages, interruptions to normal freight, government pandemic directions, natural disaster) some products may not be available for immediate delivery and will be delivered as soon as practicable.

Subject to these terms and conditions, retail orders received by us before 11:00 AEST will be shipped on the same day. Where orders are received on a non-business day, they will be shipped on the next available business day.

When you complete your order, you will be prompted to provide a delivery address. It is your sole responsibility to ensure that your delivery address is correct and Bright Viper will take no responsibility whatsoever for delivery issues relating to incorrect address information supplied by you.

All delivery addresses must be an address within Australia and cannot be a freight forwarding location. Our retail-sized items are sent via either Australia Post Standard Parcel or Express Parcel Service depending on the service you choose. Our bulk-ordered and industrial-sized items are sent via courier so deliveries cannot be made to PO Boxes. You may be required to be available in person to accept delivery of your order for any signature-based service. At the time you place your order via the website, you must advise of any difficulties that may be involved in the delivery (such as stairs, narrow entries, or pets). If you do not state the situation correctly and on arrival the delivery contractor deems it to be a difficult location, you will be liable for any extra charges including but not limited to redelivery fees, the cost of specialty delivery vehicles/equipment, or the cost of an extra person to assist. Bright Viper will not be held responsible for delivery failures or delays by any third-party delivery contractor.

We will use our best endeavours to deliver your order within any stated timeframes for dispatch, however we do not warrant that these timeframes will always be met, as many factors may affect these timeframes that are completely outside our control and Bright Viper will not be held responsible for any issues relating to delivery times.

Title and risk in the products, such as loss and damage, pass to you once the order has been processed by us and delivery has been authorised/begun by any third-party delivery contractor.

Refund, Return, and Repair Policy

This Refund, Return, and Repair Policy is applicable to products purchased from this website only. We therefore recommend you read this policy prior to making a purchase from us so you are familiar with our policy on refunds, returns, and repairs and further recommend you also make yourself aware of your rights under the Australian Consumer Law.

Order Cancellation

You can request the cancellation and refund of an order for any reason at any time prior to the order being packaged for delivery. Once the order is packaged, it cannot be cancelled and will be subject to the terms regarding returns. Due to these time constraints, it is recommended to make any cancellation enquiries over the phone +61 491 626 016, as we cannot guarantee that any other form of communication will be received prior to the order being packaged and will not be held responsible for any cancellation requests received outside these timeframes or not received for any reason.

Change of Mind Returns

Please choose carefully as returns where you have changed your mind, made a wrong selection, requested order cancellation after the order has been packaged or shipped, or simply found the goods cheaper elsewhere, are only provided at our sole discretion and will be subject to a 30% restocking fee (calculated on the order total including shipping costs) and any return freight/postage costs are payable by you. We recommend you carefully preview your shopping cart items before proceeding with your order.

Goods Damaged in Transit

If any goods arrive damaged, please fill in our returns request form within seven (7) days with all relevant details of the order, delivery issue, and any photographic evidence you can provide. We will then investigate the issue using all available means, including but not limited to, consulting with the third-party delivery company for further proof. If the damage is deemed to have genuinely been caused in transit, we will arrange for either replacement of the goods or a refund, to the value of any insurance provided by the delivery company and/or purchased by you, at our sole discretion. When required by us, damaged goods and their related postage and packaging materials must be returned in the condition received by you with all accessories and/or manuals at your own cost.

Faulty Products

Upon receipt of any goods, you must inspect them for faults. If any goods are faulty or not of acceptable quality, please fill in our returns request form within sixty (60) days with all relevant details of the order, quality issue, and any photographic evidence you can provide to receive approval to return the goods. Do not return the goods without prior approval as any such returns will not be accepted.

Once approval to return goods has been obtained, goods must be returned within a reasonable time. This time frame may vary from product to product and may depend on the type of product you purchased. Any return freight/postage costs are payable by you and reasonable costs may be refunded if the item is deemed faulty by us. Any freight/postage costs paid as part of the original order will not be refunded. Goods returned for repair will be assessed and/or repaired within a reasonable time. The assessment and/or repair time may vary due to reasons beyond our control or the repairer’s control, such as part availability and incorrect fault description.

If the goods are deemed to be faulty, we will arrange for either replacement of the goods or a refund of the original purchase price, minus any freight/postage costs and payment processing fees.

You may be required to pay labour, assessment, and any other costs, for instances including but not limited to, where goods are assessed to have been damaged by misuse or accident or where your rights under the Australian Consumer Law or any manufacturer’s warranty do not apply. We may provide you with an indicative fee, which may vary due to reasons beyond our control.

Refunds

Where we decide a refund is warranted, refunds will be processed as soon as practicable and only via the payment method used to order the product/s, where that method is still available to us. If that method is no longer available, alternative arrangements will be made.
